This Grocery Delivery Service Is Being Sued After 450+ Customer Illnesses

It issued a recall of the snack in question on June 23.

Approximately 470 reports of illnesses related to a snack sold by one of the most popular food delivery services in the U.S. have been made in the last two months, with many of them going viral on social media, and now the company is being sued. A plaintiff in Tulsa, Okla. filed a lawsuit against Daily Harvest in late June.

The snack in question is the French Lentil + Leek Crumbles, and it was officially recalled on June 23 "due to consumer reports of gastrointestinal illness and potential liver function issues," according to a notice published by the U.S. Food and Drug Administration (FDA). It says that 28,000 bags of the snack were shipped frozen directly to consumers, including to the woman who filed the new lawsuit.

She says she purchased it on May 3, consumed it on May 7 and went to the hospital on May 9 because of nausea, a headache, abdominal pain and gastrointestinal discomfort as well as right shoulder pain, according to Food Safety NewsShe was hospitalized for a total of four days and was experiencing liver and gallbladder dysfunction. On June 24, doctors reportedly removed her gallbladder.

The lawsuit says she suffered and will continue to suffer pain and discomfort and has missed and will miss work. Daily Harvest claims it alerted any customer who purchased the crumbles of the recall as well as other consumers who the company had contact information on file for on June 17 and that all were given a $10 credit for the recalled product. However, it also says that the crumbles could still be in customers' freezers.

A Reddit thread with almost 300 comments and other social media posts on Twitter, Instagram, and Tik Tok feature similar stories to the consumer who is now suing Daily Harvest. The company has come under fire for its handling of the situation, with many customers saying they were not properly notified.
